with their 4-H entry forms. _________________________________________________________________________________ WAIVER OF LIABILITY - HOLD
HARMLESS AGREEMENT July 24, 25, 26, 27 2008 The undersigned vendor or
exhibitor at the Old Home Days conducted by the Old Home Days Committee on
the premises owned by the Town of Foster, hereby acknowledges and agrees that
it has reviewed the condition of the premises and conducted such examinations
and tests of the premises as seen fit, that it is aware that members of the
public will be using the premises during Old Home Days, that it is aware that
claims against it may be made by members of the public, that it understands
and agrees that the Committee and the Town of Foster assume and accept no
obligation or liability to it in connection with Old Home Days, and that it
accepts the premises and the conduct of Old Home Days in condition AS IS and
that it will indemnify and hold harmless the Committee and the Town of Foster
from any and all claims, damages, losses, and demands of any kind whatever
and will pay the same, including reasonable attorney's fees, on account of
actions and failures to act on its part which may give rise to any claims,
damage or demand against the Committee or the Town of Foster. _______________________________________
