INTERIM EAD CARDS NO LONGER ISSUED AT USCIS DISTRICT OFFICES FOR F-1 OPT

USCIS District Offices would no longer process temporary EAD cards for most I-765 petition types as of September 1, 2006. This leads us to great concern for those long-pending F-1 Optional Practical Training (OPT) applications. We are seeking additional guidance from USCIS about the procedures at the Service Center for inquiries on long-pending cases.

A recent USCIS memo indicates that Service Centers will complete sweeps of cases that approach the 90 days regulatory guideline for processing, originally doing a sweep at cases pending 60 or 70 days to insure that processing will occur within the 90 days timeframe.

If you have a case that is pending more than 90-days, that has NOT been issued a "Request for Evidence" (RFE), contact the Office of International Students & Scholars to inform us that the I-765 application for F-1 OPT is still pending.

  • NOTE: If your I-765 case receives a RFE, the clock for 90 days processing begins again following receipt of your response to the RFE.
  • NOTE: Even if the application reaches the 91st day, you may NOT work without an EAD card.
