TO THE HONORABLE, THE HOUSE OF REPRESENTATIVES:
In accordance with the provisions of R.I. Gen. Laws § 43-1-4, I am transmitting herewith, with my disapproval, 98-H 9247, "An Act Relating to Food Markets."
I recently vetoed similar legislation, 98-H 8065, which provided that the Department of Health shall require and ensure that a notice be placed next to scales in the produce section of retail food businesses advising customers that the weight indicated on the scale is approximate and the scale has not been certified by the State Sealer of Weights and Measures. I vetoed that measure on the grounds that the provision belongs under the jurisdiction of the Department of Labor and Training which has authority over rules governing weights and measures, instead of under the authority of the Health Department.
This Act, 98-H 9247, is identical to the 98-H 8065, with the exception that this Act excludes "roadside farm stands and fanners markets." Unfortunately, the Act does not address the deficiency that formed the basis of my earlier veto. Accordingly, I must veto this Act as well.
As I indicated in my earlier veto message, I would welcome an appropriate bill during the next legislative session. Consumers are entitled to information about their purchases and to receive that for which they have paid.
For the foregoing reasons, I disapprove of this legislation and respectfully urge your support of this veto.
